COURT EXPENSES

- state duty and costs associated with the consideration of the case.

From payment of the state duty are released:

1) plaintiffs on suits: on restoration to

Work, on recovery of wages, on disputes

On authorship, on the recovery of alimony, on

Compensation of harm, compensation of material

Damage;

2) state social funds

Insurance for regressive claims;

  1. Bodies of internal affairs, bailiffs' units, tax, customs bodies, state non-budgetary funds;
  2. Minors on applications for the protection of their rights;
  1. Prosecutor, state bodies, local self-government bodies;
  2. Parties on claims: on compensation for harm, on reviewing absent court decisions, on divorce;

7) citizens on applications for the protection of their electoral rights.

Based on the property status of the parties, the court has the right to grant a deferral or installment plan to one or both parties for payment of the state fee or to reduce its size.

The claim price is indicated by the plaintiff. If the specified price of the actual value of the claimed property does not correspond to the price of the claim, the judge determines the price of the claim.

With an increase in the amount of claims, the missing amount of the state fee is paid by the plaintiff in accordance with the increased cost of the claim.

The state fee is returned in the case of:

  1. Entering a fee in a larger amount;
  2. Refusal to accept the application;
  3. Return of the application;
  4. Leaving the application without consideration;

5) the return of the appellate,

Cassation, supervisory complaint.

To the costs include:

1) amounts payable to witnesses, experts, specialists and translators;

2) expenses for travel and accommodation of the parties,

Incurred by them in connection with the appearance in court;

3) expenses for the services of representatives;

4) other court found necessary

costs.

Monetary amounts that are payable to witnesses, experts and specialists are preliminary entered in the bank account of the Department of the Judicial Department by the declaring party. When calling witnesses, specialists on the initiative of the court, expenses are reimbursed at the expense of the federal budget.

The party in favor of which the decision of the court took place is obliged to reimburse the other party for all the legal expenses incurred in the case. If the claim is satisfied in part, the costs are awarded to the plaintiff in proportion to the amount of the claims satisfied, and the defendant is proportionate to the part of the claims that is refused.

If the claimant refuses the claim, the costs incurred by the defendant are not reimbursed. In the event of a complete or partial waiver of the claim, the defendant, at the expense of the relevant budget, is reimbursed the costs incurred in proportion to that part of the claims in which satisfaction

Denied the plaintiff.

The costs incurred by the court in the consideration of the case, if the plaintiff is exempted from their payment, are recovered from the defendant. If the claim is denied, the costs are collected from the plaintiff, who is not exempt from payment of expenses.
