MISREPRESENTATION

- The result of a false statement of a party in the negotiations that led to the contract. The statement is false if:

1) contains the facts;

2) is made with the intention to force the other side to act in view of these facts;

3) leads to a significant error. The following types of administration

misleading:

1) as a result of fraud or intentional -prednamerennoe;

2) as a result of negligence - if an application or communication was made without reasonable prudence in the assessment of its accuracy;

3) unintentional (innocent) - if the party making the statement believed (and had reasonable grounds to believe) that the facts reported are correct.

Party, misrepresentation, shall be entitled to terminate the contract and demand compensation

losses. But in the case of an innocent person (unintentional) VZ losses are not always reimbursed.
