PIRACY

- The attack on a sea or river vessel for the purpose of taking possession of another's property by force or threat. As the AP also refers to:

1) unlawful violence committed for personal ends by the crew or passengers of a vessel or aircraft:

a) in the open seas, against another ship and persons who are on board;

b) against any vessel and persons in a place outside the jurisdiction of any State;

2) voluntary participation in the operation of a vessel, perfect on a pirate ship;

3) an act which constitutes incitement to commit P .;

4) acts committed by a warship, the crew who mutinied on this ship.

Any state has the right to seize the vessel P., arrested persons and property on board. Capture may only warships.

Objects crime - river and sea vessels for transportation of people and goods.

The objective side is characterized by the attack on the ship in order to seize property by force or threat.

Assault - actions connected with violence or threat of violence to the victim. It may be sudden or may not be those with the pursuit.

Violence - any action with respect to the victim committed by guilt, which can harm health.

The threat of violence - to bring to the attention of the victim's intention to commit violent acts.

The crime is considered complete from the moment of the attack.

The subjective aspect is characterized by direct intent and purpose to take possession of another's property.

The subject of the crime - the physical responsible person who has attained the age of 16 years.

When committing a crime

an organized group with a weapon may have serious consequences:

1) grievous bodily harm

several persons;

2) damage to property:

a) to citizens;

b) the State;

c) companies and organizations.

In this case, the crime is considered as completed from the moment of the consequences. PA is an international crime.
