MILITARY COURTS

Enter the judicial system of the Russian Federation, are federal courts of general jurisdiction and exercise judicial power in the Armed Forces of the Russian Federation, other troops, military formations and federal executive bodies, in which the federal law provides for military service.

VS are created on the territorial principle at the place of deployment of military units and institutions of the Armed Forces of the Russian Federation, other troops, military formations and bodies. Military courts are located in open places for free access.

VS conducts justice on behalf of the Russian Federation, considering the cases that they are subject to in civil, administrative and criminal proceedings.

The main tasks of VS in the consideration of cases are the provision and protection:

1) violated and (or) disputed rights, freedoms and legally protected interests of a person and citizen, legal entities and their

Associations;

2) violated and (or) disputed rights and interests of local self-government protected by law;

3) violated and (or) challenged rights and interests of the RF, subjects of the Russian Federation, federal bodies of state power and public authorities of the RF subjects that are legally protected.

VS conducts justice independently, obeying only the Constitution of the Russian Federation, federal constitutional laws and federal laws.

VS are amenable to:

1) civil and administrative cases on the protection of violated and (or) disputed rights, freedoms and legally protected interests of servicemen of the Armed Forces of the Russian Federation, other troops, military formations and bodies, citizens undergoing military training, from actions (inaction) of military command, military Officials and their decisions;

2) cases involving crimes committed by servicemen, citizens undergoing military training, as well as citizens discharged from military service, citizens,

Military camps, provided that the crimes committed by them during the period

Military service, military charges;

Military men, citizens, passing military training.

VS, deployed outside the territory of the Russian Federation, all civil, administrative and criminal cases subject to review by federal courts of general jurisdiction are subject to jurisdiction, unless otherwise established by an international treaty of the Russian Federation.

The VS system includes district (naval) military courts and garrison military courts.

If the military unit, enterprise, institution or organization of the Armed Forces of the Russian Federation, other troops, military formations and bodies are deployed outside the territory of the Russian Federation, military courts may be set up at the place of their deployment if this is provided for by an international treaty of the Russian Federation.

A VS citizen may be a citizen of the Russian Federation who has reached the age of 25 years, has a higher legal education, has at least 5 years of experience in the legal profession, who has not committed defamatory acts,

Qualification examination and received the recommendation of the qualification board of judges of military courts, as well as having an officer's rank and concluding a contract for military service.

The Military Collegium operates within the Supreme Court of the Russian Federation and is directly superior to the district (naval) military courts.

The military board is formed in the composition of the chairman, his deputy, the chairmen of the court structures and other judges of the Supreme Court of the Russian Federation.

The Military Collegium examines the cases, which are subject to military courts, in the following composition:

1) in the first instance, civil or administrative cases are reviewed by the judge alone or by a panel composed of three judges, and criminal cases are reviewed by a panel consisting of three judges, either a judge and a panel of jurors, or a panel consisting of a judge and lay judges;

2) cases on complaints and protests against decisions, verdicts, decisions and decisions of district (naval) military courts, which they adopted in the first instance and did not enter into force,

3) cases involving protests against decisions, judgments, rulings and decisions of military courts that have entered into force are considered by a panel of three judges. District (naval) VS operates on the territory of one or several subjects of the Russian Federation, where military units and institutions of the Armed Forces of the Russian Federation, other troops, military formations and bodies are stationed.

District (naval) VS is formed in the composition of the chairman, his deputies, as well as other judges.

A presidium is formed in the district (naval) VS, judicial panels and (or) judicial structures can be formed.

Garrison VS operates in the territory on which one or several military garrisons are deployed.

Garrison V.S. is formed in the composition of the chairman, his deputies and other judges.
