FORCED MIGRANT

- a citizen of the Russian Federation who left his place of residence because of violence committed against him or his family members or persecution in other forms or because of a real danger of being persecuted on the basis of race or nationality, religion, language, and also on the basis of belonging to a particular social group or political Beliefs that have become the reasons for conducting hostile campaigns against a particular person or group of people, mass violations of public order.

The law of the Russian Federation of February 19, 1993 is the normative base that defines the status of VP, which establishes economic, social and legal guarantees for the protection of their rights and legitimate interests on the territory of the Russian Federation in accordance with the Constitution of the Russian Federation, generally recognized principles and norms of international law and international treaties of the Russian Federation "On Forced Migrants".

V.P. admits: a citizen of the Russian Federation, forced to leave his place of residence in the territory of a foreign state and arrived in the territory of the Russian Federation; A citizen of the Russian Federation, forced to leave his place of residence in the territory of one subject of the Russian Federation and arrived in the territory of another subject of the Russian Federation.

VP is also recognized: a foreign citizen or a stateless person who permanently resides on the lawful grounds in the territory of the Russian Federation and has changed his place of residence within the territory of the Russian Federation in accordance with the circumstances provided for by law; A citizen of the former USSR who permanently resided on the territory of the republic that was part of the USSR and who obtained refugee status in the Russian Federation and lost this status in connection with the acquisition of Russian citizenship, in the presence of circumstances that prevented this person during the refugee status in settlement on the territory of the Russian Federation.

VP can not be recognized as a person:

1) who committed a crime against peace, humanity or another serious crime, recognized as such by the legislation of the Russian Federation;

2) who did not apply without reasonable excuse to petition for recognition as forced

Immigrant within 12 months from the date of leaving the place of residence or within 1 month from the date of loss of refugee status in connection with the acquisition of Russian citizenship;

3) who left the place of residence for economic reasons or because of famine, epidemic or emergency situations of natural and man-made nature.

In the sphere of social, civil and political rights, VP's rights are somewhat broader than the similar rights of refugees.

The person loses the status of VP at the termination of citizenship of the Russian Federation, and also:

1) when leaving for permanent residence outside the territory of the Russian Federation;

2) due to the expiration of the period for granting the status in accordance with the law.

The federal body of the migration service or the territorial organ of the migration service shall deprive the person of the VP status in the event that it:

1) was convicted on the verdict that entered into legal force for the commission of a crime;

2) deliberately reported false information or presented knowingly false documents that served as the basis for the recognition of his VP
