LICENSING OF COMMUNICATION SERVICES

- the implementation of activities by legal entities and individual entrepreneurs on a fee-based provision of communication services on the basis of a license.

Licensing is carried out by the federal executive body, which:

1) establishes licensing conditions, introduces changes and additions to them;

2) registers applications for licenses;

3) issues licenses;

4) monitors compliance with licensing conditions, issues instructions to eliminate identified violations, and issues warnings about suspension of licenses;

5) refuses to issue licenses;

6) annul and reissue licenses. To obtain a license, the license applicant must file an application with the licensing authority.

For submission of unreliable or distorted information, the license applicant is responsible.

Licenses are issued based on the results of trades, if:

1) the communication service will be provided using the radio-frequency spectrum. The winner is given a license, and the corresponding radio frequencies are allocated;

2) there are limited resources of the public communication network on the territory.

The decision to issue a license or refuse to issue it is accepted:

1) no later than 30 days after the date of the decision on the results of the auction conducted;

2) no later than 75 days from the date of receipt of the application with all necessary documents;

3) in other cases not later than 30 days from the date of receipt of the application on the results of the application review.

The licensing body notifies the applicant of the decision to grant a license or refuse to issue it within 10 days from the date of the relevant decision.

A fee of 300 rubles is charged for consideration of an application for a license.

A licensing fee is levied for the issuance of a license, which is paid upon receipt of a notice of a license. The license is issued within 3 days after the submission of the document on payment of the license fee.

The license is issued for a period of 3 to 25 years. For a period of less than 3 years is issued at the request of the license applicant. The term may be extended for an initial period upon the application of the licensee.

The issuance of a license may be denied if:

1) non-compliance of documents;

2) failure to submit documents;

3) the presence in the documents of unreliable or distorted information. The license applicant has the right to appeal against the refusal to issue a license.

License on the application of its owner can be re-registered as a legal successor.

If other successors concerned challenge the rights of interested assignees to reissue a license, the dispute between the parties shall be resolved in a judicial procedure.

Re-registration is carried out within 30 days from the date of receipt of the corresponding application.

Licensee may apply to the licensing authority for changes or additions to the license.

The licensing authority notifies the applicant about the decision taken within 60 days. The licensing authority may suspend the license. The notice of suspension is notified to the licensee in writing within 10 days from the date of the warning.

When eliminating violations, the licensing authority is obliged to take a decision on the renewal of its action. A decision on renewal of a license is made no later than 10 days after the date on which the licensing body receives an opinion on the elimination of deficiencies.

If you cancel a license, the license fee is not refundable. The decision to revoke the license is communicated to the licensee within 10 days from the date of adoption and can be appealed against in court.

The licensing authority forms and maintains a register of licenses in the field of communications, the information contained therein is subject to publication.

Communication facilities subject to mandatory certification are provided for certification by the manufacturer or seller.

The manufacturer has the right to adopt a declaration on the conformity of those communication facilities that are not subject to mandatory certification.

Certification of communication services is carried out on a voluntary basis. For mandatory certification, the applicant sends an application for certification to the certification body. The period for consideration of an application does not exceed 30 days from the date of receipt of the documents.

Declaration of conformity is carried out by acceptance by the applicant of the declaration of conformity on the basis of own and received evidence.

The issued declaration is registered within 3 days and is valid from the date of its registration.
