OBSERVER

- citizen of the Russian Federation, authorized to monitor the conduct of voting, counting of votes, other activities of the commission during the voting, determining its results, determining the results of elections, referendum, including the activities of the commission to verify the correctness of the establishment of voting results and determine the results of elections and referendum.

During the conduct of elections, the NA is appointed by a registered candidate, an electoral association, an electoral bloc, a public association, in the conduct of a referendum, N. may be appointed by the initiative group for conducting a referendum, by a public association.

N. can not be appointed by elected officials, persons in their direct subordination, judges, prosecutors.

N. should be provided access to the premises of the precinct commission,

N. may be not only a citizen of the Russian Federation, but a foreign citizen, i.e. A representative of a foreign or international organization entitled to exercise, in the manner prescribed by law, monitoring the preparation and conduct of elections or a referendum on the territory of the Russian Federation.

Invitations can be sent by the President of the Russian Federation, the Federation Council and the State Duma of the Federal Assembly of the Russian Federation, the Government of the Russian Federation, the Human Rights Commissioner in the Russian Federation, the Central Election Commission of the Russian Federation after the official publication (publication) of the decision to call an election or referendum. Proposals for sending invitations can be submitted by international and national governmental and non-governmental organizations, as well as individuals having recognized authority in the field of protecting human and civil rights and freedoms. The State Duma of the Federal Assembly of the Russian Federation sends invitations in accordance with the proposals of each of the political parties, each of the electoral blocs, whose federal lists of candidates are admitted to the distribution of deputy mandates.

The Central Election Commission of the Russian Federation issues a certificate of a standard form to a foreign (international) N. in accordance with the documents submitted by him, certifying the existence of an invitation from any body or person. Such a certificate gives the right to foreign (international) N. to carry out its activities during the preparation and conduct of elections or referendum.

Observers have the right:

1) to get acquainted with the lists of voters, referendum participants;

2) to be in the polling station of the respective polling station, the referendum site on the voting day, as well as on the days of early voting;

3) attend the voting of voters, referendum participants outside the voting premises;

4) observe the counting of the number of citizens included in the voter lists, referendum participants; Ballots issued to voters, referendum participants, canceled ballots;

5) to observe the counting of the votes of voters, referendum participants at the polling station, the referendum section at a distance and in conditions that ensure that the ballots of voters, participants in the referendum are included in the ballots; To get acquainted with any filled or unfilled ballot when counting the votes of voters, referendum participants; Observe the compilation by the commission of the protocol on the results of voting and other documents;

6) apply to the chairman of the precinct commission, and in case of his absence, to the person who replaces him, with proposals and observations on the organization of voting;

7) to get acquainted with the protocols of the relevant commission, lower-level commissions on the results of voting, the results of the elections, referendum and the documents attached to them, receive certified copies of these protocols and documents from the relevant commission or make copies of these protocols and documents. At the request of the observer, the commission must issue these copies or certify copies made by the observer;

8) wear a badge with a designation of their status and indication of their surname, name and patronymic, as well as the surname, first name and patronymic of the registered candidate or the name of the electoral association, electoral bloc, public organization that sent the observer to the commission;

9) appeal against the procedure (inaction) of the commission to a higher authority;

10) be present at the repeated counting of the votes of voters, referendum participants in the relevant commissions.

The observer does not have the right:

1) issue ballots to voters, referendum participants;

2) sign for the voter, participant in the referendum, including at his request, to receive ballots;

3) fill in the ballots for the voter, referendum participant, including at his request;

4) take actions that violate the secret of voting;

5) to take direct part in the ballot counting conducted by the members of the commission with the right of decisive vote;

6) commit acts that impede the work of the commission;

7) conduct agitation among voters, referendum participants;

8) participate in decision-making by the relevant commission.
