INVESTIGATION BY WISHING

Z. is committed by the action of one person, specifically directed at the transfer of property and certain non-property rights from the deceased citizen to other persons.

Z. may be committed by the testator only in person.

One Z may not be performed on behalf of several persons. The testator must be fully capable in compiling the letter.

The right to bequeath property is recognized for all citizens, arises at the moment of birth and terminates with death.

Z. can not be committed through an intermediary or representative.

The law enshrines the principle of freedom of Z., which is provided by the secret Z.

The testator may deprive in Z. the inheritance rights of all of his heirs, may leave all his property or part of it to any person, both incoming and not included in the circle of heirs by law, to distribute shares in the inheritance between the heirs indicated in the Z., Orders of the destination of the heir, testamentary refusal, imposition.

H. shall be drawn up in writing and certified by a notary or other officials.

Z. is compiled, signed

With his own hand, and is certified by a notary or an official who has the right to testify in two copies.

Closed Z. is transmitted by the testator in a sealed envelope to a notary in the presence of two witnesses who put a signature on the envelope. The envelope signed by witnesses is sealed in their presence by a notary in another envelope, on which a corresponding inscription is made.

Closed Z. must be personally signed by the testator.

To notarially certified Z. are equated:

1) Z. citizens who are on treatment in hospitals, hospitals, other inpatient medical institutions and living in homes for the elderly and disabled, certified by the chief physicians, their medical deputies or the doctors on duty of these hospitals, hospitals and other inpatient medical institutions, and Also chiefs of hospitals, directors or chief physicians of homes for the elderly and disabled;

2) Z. citizens who are on board ships sailing under the State Flag of the Russian Federation, certified by the captains of these vessels;

3) Z. citizens who are on exploratory, Arctic and other similar expeditions, certified by the chiefs of these expeditions;

4) Z. servicemen, and in the locations of military units where there are no notaries, also Z. civilians working in these parts, their family members and family members of servicemen, certified by commanders of military units;

5) Z. citizens who are in places of deprivation of liberty, certified by the heads of places of deprivation of liberty.

Deposits of citizens in banks and other credit institutions are inherited on general grounds, regardless of whether a testamentary order is made in a bank or a notary.

The testator shall have the right to cancel or replace the written Z. at any time after its commission, without specifying the reasons.

On the suit of a person whose rights or legitimate interests are violated by this Z., it can be canceled.
