LIMITATION OF PARENTAL RIGHTS

- restriction of the rights of parents towards children.

OPP is acceptable if leaving a child with parents is dangerous for him. ORP can be a preliminary measure before depriving parents of parental rights. Applicable if the abandonment of the child with the parents is dangerous for him, but there is not sufficient reason for the deprivation of parental rights.

Parents are limited in rights by a court decision. Within 3 days the court sends an extract from the decision to the registry office at the place of birth registration of the child. The body of guardianship and trusteeship within six months from the date of the decision makes a claim to the court to deprive the parents of parental rights, if the parents do not change their behavior.

The restriction deprives parents of the right to the personal upbringing of the child, the right to state benefits, but does not exempt from the obligation to support the child.

In the absence of conditions for ORP, the court may decide to abolish restrictions.
