Right of asylum

- State the right to authorize the entry and stay in its territory to foreigners who are persecuted for their political or scientific activities. This provision corresponds to Art. 14 of the Universal Declaration of Human Rights proclaims the right of everyone to seek asylum from persecution in other countries, and adopted the UN Declaration on Territorial Asylum in 1967

RF Constitution stipulates that the Russian Federation in accordance with the universally recognized norms of international law grants political asylum to foreign citizens and persons without citizenship.

The government, relying on its sovereignty in accordance with international and national law, decides whether to accept or reject the request of the person concerned asylum. The Russian state, as well as any

another, in each case arrives at its discretion. And this law of the State (or not to grant political asylum) must be respected by other States. In providing PW State decides on whether a person is really being persecuted for political reasons.

The right to asylum, which includes the entry and residence permit in the territory of that State, is called territorial asylum.

The Russian Federation provides PW individuals who seek refuge and protection from persecution or a real threat of becoming a victim of pursuit in the country of his nationality or the country of their habitual residence for

socio-political activities and beliefs which are not contrary to democratic principles, recognized by the international community, international law.

PW RF is not granted if: 1) the person is prosecuted for the acts or omissions that are recognized in the Russian Federation of a crime or has been guilty of acts contrary to the purposes and

principles of the United Nations;

2) the person involved as a defendant in a criminal case or in relation to it has come into force and subject to the execution of the conviction of the court on the territory of the Russian Federation;

3) the person has arrived from a third country, where it is not threatened prosecution;

4) a person came from a country with a developed and well-established democratic institutions in the field of protection of human rights;

5) a person came from a country with which the Russian Federation has an agreement on visa-free border crossings, without prejudice to the right of that person to asylum in accordance with the RF Law "On Refugees";

6) the person has provided false information;

7) the person is a citizen of a third country, where it is not prosecuted.

The Russian Federation is not allowed Extradition of persons persecuted for their political beliefs and also for acts or omissions not recognized as a crime in the Russian Federation. The extradition of persons accused of committing a crime, and the transfer of convicted persons to serve their sentences in

other states are carried out on the basis of federal law or international treaty of the Russian Federation.
