ACQUISITION OF CITIZENSHIP

It occurs:

1) by birth;

2) as a result of admission to citizenship;

3) as a result of the restoration of the citizenship;

4) on other grounds.

The child acquires the citizenship of the Russian Federation at birth if on the date of birth of the child:

1) both parents or a single parent have the citizenship of the Russian Federation;

2) one of his parents is a citizen of the Russian Federation, and the other is a stateless person, or declared missing, or its location is unknown;

3) one of the parents is a citizen of the Russian Federation, and the other is a foreign national, provided that a child born in the territory of the Russian Federation;

4) both parents or a single parent living in the Russian Federation are foreign nationals or stateless persons, provided that the child was born in the Russian Federation, and the State of which he is a parent or

single parent, does not give the child their citizenship.

The child, who is in the Russian Federation, whose parents are unknown, shall become a citizen of the Russian Federation, if the parents do not reappear within 6 months from the date of its discovery.

Foreign citizens and persons without citizenship, having reached 18 years of age and having legal capacity may apply for admission to citizenship of the Russian Federation, if they:

1) residing in the Russian Federation from the date of obtaining a residence permit and up to the date of the application for citizenship continuously for 5 years. Period of residence is considered continuous if the person is traveling outside the Russian Federation for not more than 3 months for 1 year;

2) undertake to observe the Constitution and laws of the Russian Federation;

3) have a legal source of livelihood;

4) applied to the body of a foreign country with a disclaimer from their existing nationality other. Failure is not required if it is an international treaty of the Russian Federation or refusal can not be in force beyond the control of the person causes;

5) speak Russian. Period of residence is reduced to 1 year in the presence of the following grounds:

1) the presence of a person of high achievements in the field of science, technology and culture, or the possession of a profession of interest to the Russian Federation;

2) the provision of the face of political asylum on the territory of the Russian Federation;

3) the recognition of refugee status. Foreign nationals and stateless persons

persons who have attained 18 years of age and having legal capacity may apply for Russian citizenship in a simplified manner, if citizens and persons:

1) have at least one parent who has the citizenship of the Russian Federation;

2) have the nationality of the Soviet Union, lived and are living in the countries that were part of the USSR;

3) are citizens of the states that were part of the USSR.

Foreign citizens and stateless persons residing in the Russian Federation, may apply for citizenship in a simplified manner without observing the conditions of the period of residence, if

said citizens and persons:

1) born in the territory of the RSFSR and had the nationality of the former USSR;

2) married to a citizen of the Russian Federation at least 3 years;

3) are unable to work and have a capable son or daughter under the age of 18 and are citizens of the Russian Federation.

Disability, foreign citizens and stateless persons arriving in the Russian Federation from the states that made up the Soviet Union, may apply for citizenship in a simplified manner without observing the conditions of the period of residence and without presenting a residence permit.

The citizenship of the Russian Federation adopted a simplified procedure and the child incapable person who are foreign nationals or stateless persons:

1) a child, one of whose parents is a citizen of the Russian Federation - at the request of parents and if the other parent's consent;

2) a child whose only parent who is a citizen of the Russian Federation - at the request of the parent;

3) a child or incompetent person under guardianship or

guardianship, - at the request of a guardian or trustee, who have Russian citizenship.

Reject applications for citizenship and restoration of citizenship, submitted by persons who:

1) in favor of a forcible change of the constitutional order of the Russian Federation;

2) during the 5 years preceding the day of treatment, statements, expelled from the Russian Federation;

3) used false documents or reported false information;

4) are in the military, serving in the security forces or law enforcement of a foreign state;

5) have unremoved or outstanding conviction for committing a premeditated crime on the territory of the Russian Federation or abroad;

6) prosecuted the Russian authorities or bodies of foreign states for crimes;

7) convicted and serving a sentence of imprisonment.
