CONFIRMATION OF COMPLIANCE

- documentary certification of the conformity of products, production processes,

Operation, storage, transportation, sale and utilization, performance of work or provision of services to the requirements of technical regulations, provisions of standards or contract terms. Objectives:

1) certification of the conformity of products, production processes, operation, storage, technical regulations, standards and contract terms;

2) assistance to purchasers in the competent choice of products, works, services;

3) increasing the competitiveness of products, works, services in the Russian and international markets;

4) creation of conditions for ensuring free movement of goods on the territory of the Russian Federation, implementation of international economic, scientific and technical cooperation and international trade.

Principles of PS:

1) availability of information;

2) inadmissibility of the use of mandatory PS to objects in respect of which the requirements of technical regulations are not established;

3) reduction of the terms of implementation of compulsory PS and expenses of the applicant;

4) inadmissibility of compulsion to implement voluntary PS;

5) protection of the property interests of the applicants.

PS may be voluntary or mandatory.

Voluntary PS is carried out in the form of voluntary certification, and mandatory - in the forms of the declaration of compliance and mandatory certification.

Voluntary PS is carried out on the initiative of the applicant. Its objects are products, production processes,

Operation, storage, transportation, sale and disposal, work and services.

The voluntary certification system can be created by a legal entity, or an individual entrepreneur, or several legal entities, or

Individual entrepreneurs.

The registration of the voluntary certification system is carried out within 5 days from the date of submission of the required documents. The registration fee is transferred to the federal budget. Refusal of registration can be appealed to the court.

Mandatory PS is carried out in cases established by technical regulations.

The object is only products that are issued for circulation on the territory of the Russian Federation.

The Declaration of Conformity and the Certificate of Conformity shall be of equal legal force.

Work on the mandatory PS is paid by the applicant.

When declaring conformity, the applicant can be: a registered legal entity or an individual as an individual entrepreneur, or a manufacturer or a seller, or performing the functions of a foreign manufacturer on the basis of a contract with him insofar as ensuring the compliance of the supplied products with the requirements of technical regulations and in part for the lack of conformity of the delivered Products to the requirements of technical regulations.

When declaring the applicant

Independently forms evidentiary materials with a view of acknowledgment of conformity of production to requirements of technical

Regulations.

The declaration is made in Russian and contains:

1) the name and location of the applicant;

2) the name and location of the manufacturer;

3) information about the object PS;

4) the name of the technical regulations;

5) an indication of the declaration of conformity scheme;

6) the applicant's statement on the safety of the product when it is used;

7) the validity of the declaration. The issued declaration is registered

Federal executive authority on technical regulation for 3 days.
