Lifetime Support With Maintenance

- Civil contract, under which the recipient of the rent - a citizen belonging to it passes a house, apartment, land or other property in the ownership of the rent payer, and he undertakes to carry out life-long maintenance of a dependent citizen and said to them a third person.

Subject of the contract - only immovable property, and rent is available in the form of provision of daily necessities of life of the recipient of rent. The agreement is subject to mandatory notarization and state registration.

The obligation to provide maintenance of a dependent may include software requirements for housing, food and clothing, and if required by the state of health of the citizen, and care for him. Contract may provide for payment of the rent payer funeral services.

The contract is to be determined cost of the total volume of maintenance of a dependent. The cost of the total amount of content per month can not be less than two times the minimum wage established by law.

Validity period of the contract is determined by the life of a dependent and frequency of content is decided on the need to meet the needs and especially not stipulated by law.

Contract may provide for the possibility of replacing the contents of a dependent in-kind payment for the life of the citizen of periodic payments in money. The payer must ensure proper condition of the property provided.

Commitment to PS I. terminated:

1) death of the recipient of rent;

2) the parties' agreement;

3) conversion of the obligation by novation;

4) unilateral refusal of the recipient of rent in the event of a material breach of an obligation on the part of the rent payer.

If the rent payer violates its obligations, the recipient has the right to rent

demand the return of real property transferred to the provision of lifelong maintenance, or the payment of the redemption price under the conditions established by law. In this case the payer of rent shall not be entitled to claim reimbursement of expenses incurred in connection with the contents of the rent recipient.
