PARTICIPANTS OF THE CRIMINAL PROCESS FROM THE PROTECTION SIDE

- persons who defend their legal rights and interests in the criminal process.

Such persons include: a suspect, accused, legal representatives of a minor suspect or accused, a defender, a civil defendant.

1) suspect - a person in respect of whom a criminal case has been initiated, or a person who has been detained pending prosecution.

The suspect is interrogated within 24 hours from the moment of detention and issuing of the decision to initiate criminal proceedings.

Rights of the suspect:

A) know what he is suspected of;

B) give testimony;

C) make motions;

D) bring complaints;

E) to get acquainted with the protocols of investigative actions;

2) the accused is the person against whom the decision was made to bring in an accused or an indictment. The accused has the right:

A) to know what he is accused of;

B) to receive a copy of the decision on bringing in as a defendant;

C) provide evidence;

D) submit motions;

E) to use the help of a lawyer;

3) legal representatives of a minor suspect or accused - parents, adoptive parents, guardians, trustees, representatives of social institutions in the care of whom a minor is in charge.

The functions of the representatives shall be terminated if the person who committed the crime reaches the age of majority at the time of the consideration of the case.

Representatives can be interrogated as witnesses;

4) the defender is a person who defends the rights and interests of the suspect or accused.

Advocate advocates, but on solicitation as a defender can act close relatives.

The defender participates in the proceedings necessarily, if the suspect is a minor, does not know the language in which the proceedings are conducted. The criminal case is examined by jurors.

The Defender has the right:

A) have a meeting with a suspect or accused;

B) present evidence;

C) be present when charged;

D) submit motions;

E) participate in the trial;

5) civil defendant - a natural or legal person, who is responsible for the harm caused by the crime.

Rights of a civil defendant:

A) to know the essence of the requirements;

6) to object to the claim;

C) give evidence;

D) present evidence;

E) to speak in the judicial debate.
