COURT EXPERT

- A person who has special knowledge, and assigned to the forensic examination and opinion. Rights E. C .:

1) get acquainted with the case materials, which belong to the forensic examination;

2) to request additional materials;

3) to participate in the proceedings with the permission of the investigating authorities;

4) within the competence to give opinions;

5) to lodge complaints against the investigating authorities that restrict his rights;

6) to refuse to give an opinion if it goes beyond the expertise.

ES has the right to:

1) negotiate with a party to the criminal proceedings;

2) independently collect materials for the research;

3) knowingly give false conclusion;

4) disclose the preliminary investigation;

5) refuses to appear in the investigative bodies.

For giving false conclusion and disclosure of preliminary investigation data ES is criminally responsible.

ES may be a citizen of the Russian Federation, which has a higher professional education and trained for expert specialization. ES in the bodies of internal affairs divisions must be a citizen of the Russian Federation, which has a secondary special education expert.

Professional level of ES and certification expert and determines

Qualification Commission. Training is reviewed every 5 years.

After examination ES is obliged to give an objective opinion on the case in writing. When ambiguity or incompleteness conclusion, the court may appoint a second opinion.
