environmental offenses

-vinovnoe wrongful act that violates environmental laws, harm the environment and human health.

Offences are divided into:

1) crime - socially dangerous act, for which there is criminal liability;

2) misdeeds - socially harmful act, responsibility for which is provided by regulations Russian legislation.

Misconduct can be classified as belonging to one or another form of ecological and legal relations. This misconduct:

1) in the field of land legal relations;

2) in the field of environmental protection;

3) in the field of forest relations;

4) in the field of mineral resources and the continental shelf;

5) in the field of water management;

6) in the field of protection and use of fauna;

The rules contained administrative responsibility regulations for environmental crimes. By the EP are:

1) violation of environmental regulations in the production of works;

2) violation of rules for handling environmentally hazardous substances and wastes;

3) violation of safety rules when handling microbial and biological agents and toxins;

4) water pollution;

5) air pollution;

6) The pollution of the marine environment;

7) damage the ground;

8) violation of rules of protection and use of mineral resources;

9) the illegal extraction of water animals and plants;

10) illegal hunting;

11) violation of fisheries regulations;

12) illegal logging;

13) destruction of or damage to forests;

14) violation of environmental requirements during the planning, design, location, construction, reconstruction, commissioning and operation of enterprises and facilities;

15) violation of environmental regulations for the disposal, processing, recycling or disposal of industrial and domestic waste;

16) exceeding the established standards of maximum permissible levels of radiation exposure, noise, vibration, magnetic fields, levels of biological effects on the environment, violation of the order of storage and use of microorganisms and biological substances;

17) provide untimely or distorted information, refusal to submit timely, complete, accurate information about the state of the environment and radiation environment.

For the EP, officials and citizens shall bear disciplinary, material, administrative, civil and criminal penalties, and legal entities - administrative and civil law.

For offenses apply: warning, fine, confiscation of the instruments of the offense; deprivation of a special law; onerous subject withdrawal which appeared instrument of the offense; deprivation of liberty; deprivation of the right to occupy certain positions or engage in certain activities; restriction of liberty; correctional work.
