KIDNAPPING

(Criminal law) - a crime against the freedom of the individual; committing illegal acts aimed at kidnapping.

The subjective side of the crime is characterized by fault in the form of direct intent, ie, the perpetrator is aware that illegally seizes another person against his will, and moves it to another location and wants it.

The subject of P. Ch can be any person who has attained 14 years of age.

Qualifying features are committing P. H .: a group of persons by prior conspiracy; with application of violence dangerous to life or health, or with threat of such violence; the use of weapons or objects used as weapons; against a minor; against a woman known by the perpetrator to be pregnant; against two or more persons; from selfish motives.

Especially qualifying attributes is the same act, if committed by an organized group; on imprudence entailed death of the victim or other serious consequences.

In accordance with the Criminal Code a person who voluntarily releases the abducted person is exempted from criminal liability if his actions do not contain structure of other crime.
