prior conviction

(Criminal law) - an element of criminal liability; It is expressed in the possibility of the occurrence of adverse citizen criminal law and general legal consequences.

A criminal record is a person who has been convicted of a crime from the date a judgment of conviction in force until maturity or overturned. Conviction is included in recidivism and sentencing.

A person who is exempt from punishment, is considered criminal record.

The Criminal Code provides for cases of cancellation of conviction:

  1. in respect of persons convicted conditionally -by after the trial period;
  2. in relation to persons sentenced to milder punishment than imprisonment - after 1 year after serving a penalty or execution;

3) With respect to persons sentenced to imprisonment

liberty for crimes of small or average gravity - upon expiration of 3 years after serving his sentence;

  1. in relation to persons sentenced to imprisonment for serious crimes - after 6 years after serving his sentence;
  2. in respect of persons convicted of the most serious crimes - after 8 years after serving his sentence.

Conviction person may be paid by the court (if the convicted person after serving his sentence behaved impeccably, by his petition, the court may relieve him of criminal record before the expiry of the maturity of a criminal record), the Russian Federation (the act of pardon) the President and the State Duma (the amnesty act ).

Redemption or removal of conviction cancels all legal consequences associated with a criminal record.
